Terms and Conditions of Sale

1. Seller

2. Scope and acceptance

These Terms and Conditions of Sale apply to consumer purchases made through the Polhus online store. They form part of the contract together with the product page, the order summary and any written quotation accepted by the customer. Placing an order means accepting the terms in force on the order date.

3. Products

Polhus sells outdoor saunas, Nordic baths and related products. Essential characteristics are described on each product page. Natural materials may show differences in grain, colour, knots and finish. Customers are responsible for checking dimensions, access conditions, foundations, local planning requirements and technical compatibility before ordering.

Installation or assembly is included only when expressly stated in the product page, quotation or order confirmation.

4. Prices and taxes

Prices are shown in euros and include VAT where applicable. Delivery, unloading, special-access, assembly or installation charges are shown before the order is confirmed or set out in a separate quotation. Polhus may change prices at any time, but the price charged is the price accepted at checkout or in the confirmed quotation.

5. Orders

The customer must provide complete and accurate information. An order becomes binding when Polhus sends an order confirmation, subject to payment authorisation, availability and any checks reasonably required to prevent fraud. Polhus may refuse or cancel an order for a legitimate reason, including an obvious pricing error, suspected fraud, unavailable stock or an undeliverable location. Any amount paid for a cancelled order will be refunded.

6. Payment

Available payment methods are displayed at checkout. Payment is processed securely by Shopify Payments or another provider shown at checkout. Where instalment payment is offered, the provider’s additional terms apply. Ownership remains with the seller until full payment, without affecting the transfer-of-risk rules applicable to consumers.

7. Delivery

Delivery areas, charges and estimated lead times are stated at checkout, on the product page, in the quotation or in the order confirmation. Because many products are bulky or prepared to order, lead times can vary. If no delivery date or period has been agreed, delivery will take place no later than thirty days after the contract is concluded, subject to applicable law.

The customer must ensure safe and suitable access, a prepared unloading area and any foundations or services described in the product documentation. Additional costs caused by inaccurate access information, failed delivery or requested specialist equipment may be charged where legally permitted and agreed with the customer.

Risk passes to a consumer when the consumer, or a third party appointed by the consumer other than the carrier, takes physical possession of the goods.

8. Inspection on delivery

The customer should inspect the packaging and goods as soon as reasonably possible, record visible damage on the carrier’s delivery document and contact Polhus promptly with photographs. This practical procedure does not limit statutory consumer rights.

9. Right of withdrawal

Consumers generally have fourteen days from physical receipt of the goods to withdraw from a distance contract without giving a reason. The customer must send an unambiguous statement to soufiakamil12@gmail.com before the period expires.

The statutory right of withdrawal does not apply where an exclusion provided by law applies, including goods made to the consumer’s specifications or clearly personalised. Where a service is fully performed during the withdrawal period at the consumer’s express request and after the required acknowledgement, the statutory exclusion may also apply.

10. Statutory guarantees

Consumers benefit from the French statutory guarantee of conformity and the guarantee against hidden defects under the conditions and for the periods provided by law. These rights apply independently of any commercial warranty. A customer seeking a remedy should contact Polhus with the order number, a description of the issue and supporting photographs.

11. Use, installation and maintenance

Products must be installed, connected, used and maintained in accordance with the supplied instructions and applicable safety rules. Electrical, plumbing, heating or structural work must be carried out by appropriately qualified professionals where required. Nothing in this clause excludes liability that cannot legally be excluded.

12. Liability and force majeure

Polhus is responsible for foreseeable losses caused by a breach of contract, subject to mandatory law. Polhus is not responsible for indirect commercial losses suffered by a consumer or for delay or non-performance caused by an event beyond reasonable control, provided the customer is informed and the legal consequences of such an event are respected.

13. Personal data

Personal data is processed as described in the Privacy Policy.

14. Complaints and mediation

Complaints should first be sent to soufiakamil12@gmail.com. If the dispute is not resolved, the consumer may contact the mediator appointed by the business: [MEDIATOR NAME, POSTAL ADDRESS AND WEBSITE — TO BE COMPLETED]. Mediation is free of charge for the consumer after a prior written complaint.

15. Governing law

These terms are governed by French law. Consumers retain any mandatory protections of the country in which they habitually reside. Any dispute may be brought before the courts competent under applicable consumer-protection rules.
